MEETING WITH MEMBER INCONCLUSIVE…..

JAC leaders met the Member (P&V) at her chamber as scheduled.  Meeting took place in a very serious atmosphere with a 14-member delegation of JAC on one side and a 7-member official side including DGHRD and Director.  Madam admitted problems with the DOPT in approving the CR proposals in the present form.  The JAC insisted for the status and shape of the present proposals and also the feedback for the memorandum submitted on 25.1.2011.   Our Association represented by the President and the SG reiterated our demands for at least three functional promotions up to JC level and actions to remove regional disparity by creating all-India seniority for Inspectors.  After heated and prolonged discussions, the Member borrowed more time to revert back to us.  We have set a deadline of 2nd week of April in writing.  A communication on the same lines was sent to the Hon’ble FM with a copy to Secretary, DOPT. 
Other issues taken up during the visit:
1.       Ratio to the promotion to Gr.A level:
 The application filed by the Board to review the retrospective effect for the new ratio for promotions to the grade of Gr.A officers, is coming up before the Hon’ble SC on 30.3.2012.  Though it is evident that our Board is backing the interests of Customs Appraisers, justice would be meted out by the apex court.   
2.       Pending issues on ICT:  
As regards ICT, another representation dt.23.3.2012 was given to the Chairman, CBEC which is reproduced here.   Necessary follow up action has to be done in this regard vigorously for which affected Circles should also act to pursue the CCAs to represent to the Board.
3.       Notional fixation of pay w.e.f. 1.1.1996:
Department of Expenditure was contacted for the status of Judgment of Hon’ble CAT, Mumbai Bench.  No decision has yet been taken on the same though an appeal is a certainty.   Meanwhile we are also going ahead with an application before same Bench for a similar relief.
4.       Fixation of 7450 basic pay:
DoE was contacted over this issue and they are waiting for further instructions from the DOPT to settle the issue amicably.
5.       Unified GPF account No.:
It is confirmed that the office of the CGA has already initiated steps for development of a web based centralized GPF Accounting System on outsourced basis through NIC.

                          Subject:  Denial of benefit after lifting of ban on ICT.

          Kind attention is invited to the Board’s letter F.No.A22015/23/2011-Ad.III.A dt.27.10.2011 lifting the ban on Inter Commissionerate Transfer which was in vogue since 19.2.2004.  The Association vide letter dt.24.11.2011 has pointed out certain areas of concern like consideration of applications of transferees who are on probation, repatriation of officers under deputation etc. which are yet to get the active consideration of the Board.

2.       It is also matter of grave concern that many cadre controlling authorities are not forwarding the applications of transfer seekers on the grounds that there are shortages of Inspectors.   Needless to emphasise, it is the duty of the responsible administration to get the post of Inspectors filled through DR and promotion as and when the vacancy arises.   It may be noted that only after much persuasion, the ban on ICT which was in effect for more than 7 years, has been lifted and in order to get the benefit out of it, there should be a uniform policy amongst the CCAs to consider the applications for ICT received by them.  It is noticed that the situations at Chennai  and Kerala zones are acute and the officers, who are far away from their home, are highly disturbed  as their applications on genuine grounds are not being considered, when their junior colleagues in other zones are getting ICT based on the Board’s letter dt.27.10.2011.

3.      View above, it is requested that instructions may kindly be issued immediately to all the CCAs to have a uniform policy to consider all the applications received for ICT so that no Inspector is deprived of his legitimate right in getting the ICT in time. Passionately we would like to request you that all the pending points raised in the Association’s letter dt.24.11.2011 like probation period and repatriation may kindly be cleared without further delay.

meeting on 23rd resheduled on 27th of March

The meeting which was slated to be held on 23rd March,2012 now rescheduled and to be held on 27th of March. This is because of an emergency court case that CBEC has to attend. In addition to this it was understood that the restructuring file is going to be cleared keeping it in mind the strength of 64,000 employee of CBEC.,

It is announced for general information that during the year 2011-2012, accumulations at the credit of subscribers to the General Provident Fund and other similar funds shall carry interest at the rate of 8% (Eight per cent) for the period from 1.4.2011 to 30.11.2011 and 8.6% (eight point six percent) with effect from 1.12.2011.  The funds concerned are:—

Interest rate for GPF, CPF and other provident funds hiked to 8.6%

While we received the happy news that Government issued orders for grant of one increment in pre-revised pay scale for those who were due for their increments between Feb-2006 to Jun-2006, another long pending demand of the employees for enhancing the interest rate on Provident funds has also been considered in favour of employees to some extent.

In the resolution F.No: 5(1)-B(PD)/2011 dated 19.03.2012, the Ministry of Finance has announced that the following Provident funds in which Central Government Employees subscribe for their retirement benefit will carry interest at the rate of 8.6% with effect from 01.12.2011.  However, the these provident funds will remain to fetch interest at the rate of 8% from 01.04.2011 to 30.11.2011.

OFFICE MEMORANDUM

Subject:— Central Civil Services (Revised Pay) Rules, 2008 — Date of next increment in the revised pay structure under Rule 10 of the CCS(RP) Rules, 2008.

In accordance with the provisions contained in Rule 10 of the CCS (RP) Rules, 2008, there will be a uniform date of annual increment, viz. 1st July of every year.  Employees completing 6 months and above in the revised pay structure as on 1st of July will be eligible to be granted the increment. The first increment after fixation of pay on 1.1.2006 in the revised pay structure will be granted on 1.7.2006 for those employees for whom the date of next increment was between 1st July, 2006 to 1st January, 2007.

2. The Staff Side has represented on this issue and has requested that those employees who were due to get their annual increment between February to June during 2006 may be granted one increment on 01.01.2006 in the pre-revised scale.

3. On further consideration and in exercise of the powers available under CCS(RP) Rules, 2008, the President is pleased to decide that in relaxation of stipulation under Rule 10 of these Rules, those central government employees who were due to get their annual increment between February to June during 2006 may be granted one increment on 1.1 .2006 in the pre-revised pay scale as a one time measure and there after will get the next increment in the revised pay structure on 1.7.2006 as per Rule 10 of CCS(RP) Rules, 2008. The pay of the eligible employees may be re-fixed accordingly.

4, In so far as the persons serving in the Indian Audit and Account Department are concerned, these orders are issued in consultation with the Comptroller & Auditor General of India.

LETTER dt.12.3.2012 TO THE SG, AIACEGO.

Sir,

Information received from reliable sources reveal that there is going to be a 30% cut in Group – A post, from the proposal made by the Board. It is apprehended that the proposal for creation of Audit Commissionerates would be abolished. In the present situation, promotion chances to the entry level of Class – I is going tobe  reduced substantially by virtue of which the stagnation in the grade of Superintendent of CEX will remain as such and may further aggravate.   Acceptance of present format of CR may cause great loss in the career progression. At this crucial juncture it is imperative to fight together. Hence I earnestly appeal to you to join / support the agitation call given by the Joint Action Committee under CBEC.  You are also requested to give suggestions in this matter so that a sustainable fight/agitation could be launched. After the agitation program on 16th March 2012, as per your convenience, you may call a joint meeting with me and other leaders of JAC at any place decide by you for discussion in this matter.

UPDATE ON CADRE RESTRUCTURING

IT IS UNDERSTOOD THAT THE FILE OF CADRE RESTRUCTURING HAS COME BACK TO HRD YESTERDAY. IT APPEARS THAT THERE WOULD BE CONSIDERABLE REDUCTION OF POSTS ACROSS THE CADRE. THE OUTCOME WOULD BE UNSATISFACTORY TO ALL CADRES. OUR PROGRAMME FROM 16.3.2012 IS ON. ALL ARE REQUESTED TO PARTICIPATE IN 16TH WALKOUT FOR TWO HOURS(IE. FROM 14.00 HRS TO 16.00 HRS.). ALL THE OFFICE BEARERS ARE REQUESTED TO ORGANISE MEETINGS IN EVERY CORNER OF THE COUNTRY TO MAKE IT A GRAND SUCCESS. FIVE ORGANISATIONS OF THE JOINT ACTION COMMITTEE HAVE ALREADY WRITTEN A LETTER TO FINANCE MINISTER IN THIS REGARD.
