GOVERNMENT RELEASED GAZETTE NOTIFICATION IN NIGHT

Dear Comrades - The Gazette Notification by the Government of India has been published yesterday night in the website of Ministry of Finance. However comrades who want to verify the original Notification of Gazette can visit the Finance Ministry website http://www.finmin.nic.in - Both Hindi and English version of Notification is available in the above Finance Ministry website. Since the official Notification has been published by the Government, A.I.C.E.I.A is giving out its priliminary comments and observations on the common issues hereunder:

A.I.C.E.I.A REACTION


NEGATIVE:

1. As already analysed by the National Executive of Confederation of Central Government Employees the denial of Need Based Minimum Wage as per 15th ILC norms Rs.10,000 for Group 'D' but only granting of Rs.7,000 as Minimum wage to Group 'C' is most disappointing.

2. The fitment formula of 1.86 times of basic pay as on 1.1.2006 do not ensure even minimum wage rise of 40% to employees while the Group A officers

3. Group D employees without Matriculation qualification would only get the fitment in 1S scale with 1300/- grade pay and not PB-1 scale with 1800/- pay now until they are retrained suitably. The Non-Matriculate Group D officials who retired between 1.1.2006 and now would not be eligible for the PB-1 at all and thus deprived even this minimum wage of 7,000/- level and therefore their pension benefit would go down. A major disappointment.

4. Recommendation of pay commission to not to allow Merger of Dearness Allowance with Basic Pay at any stage is accepted. This is going to make a big difference and negative impact on our wages in future.

5. Special Duty Allowance [SDA] is accepted by the Government as recommended by pay commission only and without any modification sought for by the Staff Side to ensure the Allowance paid without any condition for all employees working in the NE Region. Notification says that employees without any all India transfer liability condition but transferred within the Region from one area to another are made available with the SDA. This will however cause denial to large number of employees who are not transferred from their area of recruitment to another area.

6. Government's acceptance of Non-selection grade for Superintendents of C.Ex. and I.T.O’s have less/no effect on the Superintendents of Central Excise, as most of the inspectors’ get their promotion after completion of 16 to 24 years of service so after completion of 20 years they will automatically get the benefit of next A.C.P.
7. The revised pay scale of Inspectors from 01.01.1996 had not been given .
8. Flexi-time for women employees and flexi-week recommended for physically challenged are rejected by the Government.


POSITIVE:


1. Transport Allowance for those employees in the basic pay of 4000/- in revised pay scales also will be on par with those who are in grade pay level of 4200/- to 4800/-. These employees will get 1600/- + DA on it in Metro Cities and 800/- + DA on it in all other places.
2. Though nothing specific had been written as regards pay scale of Inspectors of Central Excise, Customs and Income-tax, yet, as par Part-‘B’ REVISED PAY SCALES FOR CERTAIN COMMON CATEGORIES OF STAFF section-I clause(ii) it appears that the initial grade-pay may change at the time of fixation.
2. Campus restriction for Transport Allowance is removed by the Government so that all employees who occupy campus attached quarters [like SPM Quarters] will also be eligible for Transport Allowance.

3. The modification by the Government for granting two uniform dates of annual increments to facilitate drawal of increment either on 1st January or on 1st July is an improvement.

4. Benefit of one increment is given to avoid bunching of more than two stages in the revised running pay bands [But @ 3% of basic pay in pay band without including Grade Pay].

5. Rejection of the recommendation for reducing the Holidays only to National Holidays and allowing the status-quo is welcome.



CONCLUSION:

The National Executive of the Confederation’s decision to go for an indefinite strike is the only alternative for opposing the retrograde stand of the Government on many issues like Need Based Minimum wage, Denial of Minimum 40% fitment benefit to all, Denial of Transport Allowance minimum 1200/-+DA on it for Metro and 800/-+DA on it for other places, Denial of Minimum 10% fixation benefit on promotion, Non-acceptance of SDA for all employees in NE Region etc. Let us concentrate to build a powerful movement by forging unity with all possible organisations outside the Confederation and let lose a powerful campaign and agitational programme to culminate in indefinite strike. Acceptance without further increase would result in huge loss.

CIRCULAR 6/08

Circular-6/08

On 25th August we were in the North Block to pursue various issues already taken up with the Member and Chairman of C.B.E.C during our earlier visits. On 26th morning we were able to meet Chairman and requested him:
· to resume the inter Commissionerate transfer at the earliest,
·
to stop the direct recruitment of appraisers, to stop utilizing inspectors in different nature of jobs ( like D.E.O, P.A etc),
·
to provide an office room in New Delhi for The All India Association.

Follow up action in respect of the points given below were done at various Sections

  • A.C.P anomaly of 1992 batch inspectors
  • Counting of regular service for granting A.C.P and promotion.
  • Unified G.P.F account.
    ORGANISATION
    On 25th and 26th of August a meeting of the available office bearers was held at Delhi. The venue of the next CEC meeting was the main agenda of the meeting. Superintendent Association had submitted one letter requesting us to participate in a rally that has been organized in Delhi on 16th of September. We have discussed the matter at length and decided to extend our moral support. The letter is reproduced below:

    The Association in its AEC meeting held on 9th and 10th of August, 2008 has decided to organize a protest procession to parliament on 16th of September, 2008 against the indifferent attitude and dilatory tactics of the Central Board of Excise & Customs towards the acute stagnation confronted by the Group-‘B’ Executive Officers (gazetted and non-gazetted) causing hostile discrimination and serious pay erosion.
    The Association requests to participate in the said programme for the sake of solidarity and unity.

    IMPLEMENTATION OF 6TH CPC REPORT – MEETING OF CONFEDERATION

    The cabinet has decided to implement the 6th CPC recommendations without accepting any of the major suggestions made by the employees’ organizations to the Committee of Secretaries. The Govt. has accepted only those suggestions made by the Group-‘A’ officers’ organizations. The employees had demanded that the Govt. must re-determine the minimum wage at Rs. 10,000 computed on the basis of the 15th ILC norms. Had the minimum wage been computed even as per the formulations made by tbe 5th CPC, it should have been Rs. 7400/-. The Govt. had announced in March, 2004, that the Commission's recommendation to raise the salary by 40% would be accepted. Since the fitment formula suggested by the Commission had not brought about the uniform rise of 40%, the employees organization before the Committee of Secretaries had pleaded for the revision of the same. As per the 6th CPC recommendation, the fitment benefit was of the order of about 180% for senior officers and as low as 12% for a certain segment of employees. Had the suggestion of the employees organizations been accepted, it would have only brought about the uniform benefit of 40% for all employees without reducing the grand benefit bestowed on the top level officers of the Govt.. By not accepting this, the employees will continue to have a depressed wage for a long time to come.
    The Govt. has not done anything to correct the wide disparity in wages amongst the employees and officers accentuated by the recommendation of the 6th CPC, which was the root cause for discontent amongst the employees. The declaration made by the Govt. that the minimum wage would be raised to Rs. 7000/- is in fact a misnomer. The Wage of a group D employees is considered to be the minimum wage. It is decided to be at Rs. 6046 even after the Cabinet decision. It is only in the case of the lowest grade of Gr.C. cadres, the minimum wage is at Rs. 7000. This is far below even if the computation of minimum wage is made on the 5th CPC recommendation, which would be Rs. 7400. The employees are to suffer in their wages in the long run as the pay bands have been created on this premise.
    The Commission has recommended for the abolition of about 9 lakhs Group D posts. The Group D functions would be contractorised. No decision seems to have been taken by the Govt. to reverse this recommendation.
    In short the present decision of the Government is disappointing in so far as employees are concerned as none of their major suggestions has been accepted by the Govt. The National Executive of the Confederation met on 26.08.2008 to decide upon the future course of action. It appealed all Central Government employees to demonstrate their discontent and disappointment and to muster with other sections of the working class. It was decided that the confederation will indulge itself into mass mobilization against the discriminatory suggestions of VIth Pay Commission which ultimately culminate into an indefinite strike and a strike notice will be served by the mid of December.

Postponement of the date of the C.E.C meeting at Trichi

In slight modification of our earlier notice I do hereby in the capacity of secretary general in charge like to affirm that the meeting of the Central Executive Committee of the All India Central Excise Inspectors’ Association is rescheduled on 19th and 20th of September instead of 6th & 7th of September, 2008 at Trichy, Tamilnadu.

The meeting is scheduled to commence at 10.00 am. On 19th of September,2008 and it will conclude at 13.00 hrs. of 20th of September,2008.

Charter of Demands.

The demands adopted by National convention of Central and State Government employees and University, college and School teachers on 8th July, 2008

Accept the modifications suggested by the Staff Side JCM in the Standing Committee meeting held on 7th May, 2008 and implement the 6th CPC recommendations accordingly.
Afford right to strike to Government employees
Withdraw the new contributory Pension scheme and extend the existing defined benefit pension scheme to all Govt. employees including those recruited after 1.1.2004.
Stop privatization, corporatisation and downsizing of Government department and abandon the neo-liberal economic policies.


The Demands adopted in National Convention of Trade Unions on 13 May 2008
Take urgent step to contain price-rise through (a) universalizing the public distribution system throughout the country to cater all essential commodities at controlled price through PDS, (b) ban on futures and forward trading in all essential commodities, (C) reduction of tax in petrol and diesel, (d) stringent action against hoarding and black marketing.
Strict implementation of all labour laws particularly in respect of minimum wages, working hours, social security and safety and stringent action against all cases of violations; stop contractorisation and outsourcing
Scope of the Unorganised Sector Workers Social Security Bill pending in Parliament should be expanded to cover all unorganised sector workers irrespective of BPL or APL category to ensure a national minimum social security benefit for them as per unanimous recommendation of the National Commission for Enterprises in the Unorganised Sector (NCEUS) and the Parliamentary Standing Committee on Labour with Central Govt Funding.
Farmers Loan Waiver Scheme to be extended to loans from private moneylenders; nationalized banks to extend easy credit to peasants at lower interest rate.
Lift ban on recruitment in Govt services; remove the negative and discriminatory features in the recommendation of 6th Pay Commission and finalise the same for implementation in consultation with the employees organisations; expedite regularization and grant of pension to 'gramin dak-sevaks.'
Expedite wage negotiation for the employees of Central PSUs including the contract workers without any conditionality.
